Terms and Conditions for Using "Dars" App

Introduction

By using the Dars application, you agree to abide by the following terms and conditions of use, which govern the relationship between the application and you regarding this application and your use of it.

The purpose of these terms and conditions is to define ownership and responsibilities between the consumer (the client) and Company 00000 (the service provider / Dars App) regarding the use of the application and its policy, as follows:

Definitions
  • Service Provider: Company 000000 is a limited liability company registered in the Kingdom of Saudi Arabia under Commercial Registration No. (000000). It is referred to in these terms and conditions as the Service Provider under the name (Dars App).
  • Clients - Client - Student: Anyone wishing to benefit from the products and services provided by the Service Provider, whether individuals or legal entities.
  • Service: Service means providing the Dars App services through the application and delivering them to the client.
  • Teacher/Instructor: The one who delivers the service to the client through the Dars App.
  • Order: The Dars application.
  • Products and Services: The products or services offered and provided through the application.
Overview
  • - Dars App is a cloud-based system that primarily provides private in-home tutoring, online distance learning, and training courses delivered by teachers through the application. The client can request these products or services via the application, and they will be delivered by a specialized team under the supervision of the app. The app is managed by the Service Provider in accordance with its management policy. These terms and conditions apply and must be interpreted according to the laws of the Kingdom of Saudi Arabia.
  • - We reserve the right to introduce new services, update any existing services, or withdraw them at our sole discretion without any liability.
Registration Terms
  • - You are entitled to register as a client to benefit from the services if you meet the following eligibility criteria:
  • 1. You must be of legal age to be able to request services in your country of residence.
  • 2. You must be able to provide a clear and suitable address for receiving the services.
  • - To register on the application, we will need you to provide some information. Your registration will not be accepted if you fail to provide the required information. We also reserve the right to reject any registration without giving reasons and may perform the necessary verifications to confirm your identity and registration requirements.
  • - Once registration is successfully completed, your account will remain valid for an indefinite period, subject to possible suspension or cancellation in case of any violation of the application’s terms and conditions.
Registration Data and Account Security
  • The accuracy, correctness, and completeness of the provided data, and maintaining it in the required and commonly accepted format.
  • Maintaining the confidentiality and proper use of your username and password.

By using or accessing the services, you agree to the following:

  • 1. You are responsible for maintaining the privacy and restricting access to your account and password, and you agree to bear responsibility for all activities conducted under your account and password.
  • 2. You agree to immediately notify us of any unauthorized use of your password or account, or any other breach of the site’s safe usage standards.
  • 3. You will provide complete, truthful, accurate, and up-to-date information about yourself and your use of the services as defined by us, and cooperate with our requests for additional information.
  • 4. You will not disclose to others (except as required or as specified by us) any user information provided to you.

By using or accessing the services, you agree that you will not do the following:

  • 1. Post, list, or upload any inappropriate or prohibited content or materials...
  • 2. Post materials that you are not entitled to share or publish.
  • 3. Post counterfeit or stolen materials.
  • 4. Violate or attempt to circumvent the law...
  • 5. Use the services if you no longer meet the eligibility requirements...
  • 6. Fail to pay for services and products...
  • 7. Interfere with the listings of other users.
  • 8. Take any action that may lower the site’s ratings or ranking systems.
  • 9. Post false or inaccurate content...
  • 10. Transfer your account to another party without obtaining prior written approval from us.
  • 11. Post unwanted messages or spam emails...
  • 12. Post viruses or any other technologies that may harm our services...
  • 13. Violate copyright laws, trademarks, or other rights...
  • 14. Collect user information without their consent.
  • 15. Bypass any technical measures we use to provide the services.
  • 16. Accept all risks arising from unauthorized access...
  • 17. The client acknowledges being solely responsible for keeping the password and any other account data confidential...
How the Application Uses Your Personal Data
  • - The application does not collect any personal data about the client unless the client uses the application services...
  • - The purpose of collecting the client’s personal data is for the following:
  • To communicate with the client regarding their experience with the application.
  • To register the client in the application, verify their account, and link it with their phone number and email address.
  • To send and notify the client about promotional offers...
  • For measuring the time taken in the delivery process.
  • To improve the application in line with the client’s experience and usage.
  • - The Ders application is committed to maintaining the confidentiality of client personal data.
  • - The application needs to collect this data for internal statistical purposes...
  • - The Ders application undertakes not to share, disclose, or transfer this data to any third party except for the purposes defined in section six of these Terms and Conditions.
How the Application Works
  • The service provider markets the services and products (teachers) by showcasing them through the application and making them available to clients.
  • The service provider receives service and product requests chosen by the client through the application.
  • The client confirms the order and selects the appropriate payment method from the options available in the application.
  • The client has the right to choose the service delivery method from the available options: either by the teacher attending in person at the client’s home, at the teacher’s place, at an external location, or online (electronically)...
  • If a delivery method is selected, the service provider will deliver the client’s request to the teacher chosen by the client and follow up on the order until it is delivered to the client.
  • Services are carried out at the same time specified by the client by the teacher after receiving the order.
Payment Methods and Procedures

Customer requests and services provided by Dars App are processed after the customer pays the pre-specified order amount.

When the customer makes a payment through their account in Dars App, they will be required to provide some common details during the payment process, such as name, address, bank account information, and other payment-related data, either to Dars App accounts or to teachers ' accounts when necessary as a third party (the payee, the collection service provider). Therefore, the customer must ensure the accuracy, completeness, and validity of the provided data during the payment process, select the payment method, and keep the data updated from time to time.

Note: ** Payment methods include using an external collection service provider. The third party and the app may charge the customer additional fees when processing payment services. The app is not responsible for any of these fees and bears no liability. The consequences of using third parties as a payment method for customer requests, in addition to the customer’s payment method, may also be subject to the terms and conditions imposed by the collection service provider (the third party). Therefore, please review the third party’s terms and conditions before using the customer’s payment method.

The customer also authorizes Dars App to store payment method information and collect fees as outlined in the above terms. In case of any change in the customer’s account details or payment method, including but not limited to: (account number, expiration date, or any other verification documents) due to reissuance or otherwise, Dars App has the right to obtain this information from the collection service provider (third party) or the customer’s bank and update the registered payment method in the Dars App account.

The customer is solely responsible for the accuracy, validity, and completeness of the payment-related data, and the app cannot be held responsible for any loss resulting from misconduct, errors, or invalid data provided either by the customer or any third party.

Please note that all service and product prices available for ordering via Dars App are subject to Value Added Tax in accordance with the regulations of the Kingdom of Saudi Arabia.

Customer Obligations
  • 1. Agreeing to company policies, management assessments, schedules, acquired rights, obligations, and stated terms.
  • 2. Agreeing to the right of Dars App to amend and modify the terms and conditions and the privacy policy.
  • 3. Accepting the service from the specified teacher and refraining from otherwise; in case of acceptance outside this, the app bears no responsibility.
  • 4. For home service requests, the customer must not delay in receiving the teacher at the scheduled time. If the delay exceeds (51) minutes, the lesson time calculation will be activated.
  • 5. After placing the request and its acceptance by the app and the teacher, the service is confirmed at the scheduled time. If the customer wishes to postpone, they are entitled to reschedule at least (120) minutes before the set time.
  • 6. After ordering services or products and making payment, the service cannot be canceled, and the paid amount cannot be refunded.
  • 7. Taking responsibility for delays, including all resulting losses or compensations if the teacher is not responded to on time.
  • 8. The customer is not entitled to transfer, publish, or record any content purchased from the app, whether related to recorded lessons, courses, or any available services.
  • 9. Agreeing to the app’s right to utilize the customer’s registered information and data, and granting the company the right to use it for purposes that do not harm the customer, such as quality assurance, research, and marketing.
Refund and Exchange Policy
  • 1. The customer has the right to request a refund if the provided services or products are found to be inconsistent with the description, within no more than "3" business days of review. This is subject to the app’s evaluation and verification.
  • 2. The customer has the right to request a replacement teacher if they purchased the service for more than one (1) hour, provided it is divided across different days as desired. This is subject to availability of teachers and their schedules, without commitment to the previous teacher’s times.
  • 3. Services of a special nature cannot be refunded or exchanged, such as discount periods or final exam seasons.
  • 4. The customer is not entitled to claim a refund after service or product confirmation without a valid reason, except as stated in clause (1) of the exchange policy.
  • 5. If there are remarks regarding the services, the customer must contact the service provider in writing via email for Dars App customer support, in cases of dissatisfaction with the quality of services or products due to substantial issues. Compensation will be issued to the customer in their wallet or bank card after confirmation by the specialized Dars team.
Control Over App Usage

Dars App reserves the absolute right, without the need to provide reasons, to refuse or suspend any user’s access to app services through any means deemed appropriate by the app’s management.

Modifications to the App and Terms & Conditions

Dars App reserves the right at any time to make modifications or additions to the app as a whole or any part of it. These terms and conditions may also be updated from time to time. As a user, it is your responsibility to review updates to these terms through repeated visits and use of the app. Accordingly, you will be deemed to have agreed to these modified terms and conditions if you continue using any of the services provided by the app after any amendments are published. The app also reserves the right to add, modify, or delete any of these terms and conditions, and you remain bound by the same responsibilities and obligations. Changes become effective once published within the section dedicated to Dars App’s Terms and Conditions.

Suspension, Termination, or Cancellation

Without prejudice to any rights, remedies, or liability towards you, we reserve the right to limit, suspend, or withdraw your access to or use of services, cancel any product orders, and/or delete content provided by you at our sole discretion. For clarity, any amounts paid and received by us related to a canceled product order will be refunded.

Liability and Indemnification
  • - The app provides no warranties, express or implied, regarding the services. They are provided "as is," and all warranties are expressly disclaimed to the fullest extent permitted by law...
  • - In no event shall the app, its agents, licensors, or affiliates be liable for any direct, indirect, punitive, special, incidental, or consequential damages...

Reporting a Violation of Terms of Use

We are committed to ensuring that the products and content on the website comply with these Terms of Use. If any content does not comply with these Terms of Use, please notify us and we will investigate the matter.

Notifications and Communications

The service provider will use the email address provided by the service requester when creating an account on the application and/or the communication feature provided by the application for the purpose of sending any notification or communication related to these terms and conditions. The service requester shall be deemed to have received the notification once it has been sent to the mentioned email address or via the other communication feature agreed upon.

Communications directed to the service provider will not be effective unless they are sent to the following email address 000000, provided that the sender receives a delivery confirmation.

Intellectual Property Rights

Access to the application and the information contained therein does not establish, transfer, or constitute in any way any validity, rights, or intellectual property privileges of the data, information, trademarks, copyrights, designs, patents, company names, confidential information, trade secrets, or any other intellectual property rights that may belong to the application, author, translator, creator, or licensor.

All trademarks, logos, company names, and other intellectual property in relation to the application or any information contained or accessible from it remain the sole and exclusive property of the application and the relevant authors or licensors. The client undertakes not to use, publish, or deal with such intellectual property in any other way without prior written consent from the application, the licensor, or the author.

Force Majeure

No party shall be held responsible for any loss, damage, delay, or failure to perform due to circumstances beyond the control of any of the parties, whether foreseeable or not (such as acts of God, actions by legislative, judicial, or regulatory authorities, actions by subcontractors, third-party service providers, economic disruptions, or complete power outages).

Invalidity of One or More Provisions

The invalidity of any provision of these Terms of Use shall not affect the validity of the remaining provisions. If any court or regulatory body determines that any provisions are invalid or unenforceable, such provisions shall be nullified and removed, while the remaining provisions shall remain in full force and effect.

Policy on Misconduct and Unacceptable Behavior

The company is committed to providing a safe and healthy work and service environment for all employees, service providers, and beneficiaries. This policy aims to clarify unacceptable behaviors and the procedures for dealing with them.

1. Unacceptable behaviors include:

  • - Using offensive language or threats.
  • - Any form of harassment, whether verbal or physical.
  • - Insults or ridicule of another person.

2. Reporting Procedures

  • - Anyone subjected to or witnessing misconduct must immediately report it to [name of responsible person or department].

6. Victim Support

  • - The organization provides psychological and legal support to victims.
  • - We reaffirm our commitment to supporting all affected individuals.

7. Regular Policy Review

- This policy will be reviewed periodically to ensure its effectiveness and updated as needed.

Assignment

The application reserves the right to assign or transfer any or all rights and obligations under these terms and conditions to any third party.

Governing Law and Jurisdiction

These terms and conditions, and the settlement of any dispute, claim, or conflict arising from or related to them, their violation, termination, enforcement, interpretation, or validity, or the use of the application or service, are governed by and interpreted in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia. Any dispute shall be referred to the competent courts in Riyadh.
